Labelling AI content on TikTok

TikTok's exceptions for AI content differ from those in the EU guidelines.

TikTok requires realistic AI-generated content to be labelled and also detects AI through C2PA Content Credentials.

In ads, heavily edited or AI-generated content needs the AIGC label or your own clear disclosure. TikTok's exceptions for minor edits do not replace your check under Article 50 of the AI Act.

What TikTok requires

Posts

According to its newsroom (19 November 2025), TikTok requires people to label realistic AI-generated content with the tools in the app. TikTok also detects AI through C2PA Content Credentials and its own detection models. If content is edited elsewhere and reuploaded, such data can be lost, so TikTok is also testing invisible watermarks.

Ads

Under the ads policy (as of April 2026), heavily edited or AI-generated content may only run with the AIGC label or your own clear disclosure. According to TikTok, minor changes such as lighting, brightness, colour, removing or changing the background, and denoising are exempt.

How this relates to your Article 50 duty

Deep fakes that you generate or manipulate with AI in your business, or have a contractor create to your instructions, must be disclosed (Article 50(4) AI Act, guidelines paras. 12 and 14). This applies in your own store and on every platform.

Under the guidelines, a purely decorative AI background behind a real product generally does not need a label, but a background that creates a deceptive scene can. TikTok, by contrast, exempts background changes in ads.

The Commission lists TikTok as a very large online platform. There, deployers may rely on the platform's labelling tools under para. 126 of the guidelines if they allow a clear and distinguishable disclosure. How far this carries is not settled, especially for notices that appear only sometimes or only after a click.

Steps

  1. Check every AI creative with the labelling check.
  2. For posts with realistic AI content, add TikTok's AI label when uploading.
  3. In ads, add the AIGC label or your own clear disclosure in the creative, for example with Label an AI image.
  4. Keep C2PA Content Credentials in your files. They help TikTok detect AI.

Not legal advice. The current wording of the platform rules is what counts. A label does not make a misleading image lawful.

Frequently asked questions

Is TikTok's AIGC label enough?

It is not settled how far para. 126 of the guidelines lets you rely on it. A clear label visible without a click is the safe route.

I only changed the background with AI. Do I need a label?

In TikTok ads, this is an exception. Under Article 50 it depends on whether a deceptive scene results.

Does TikTok detect AI automatically?

Partly, through C2PA Content Credentials and its own models. Such data is easily lost on reupload, though.
